Apache with Secure Web Server Code and Modifications Agreement

A copy of the Apache Web Server with secure web server support source code ("Apache code") with certain modifications included to enable the Apache with secure web server support code to be used with TPF (updated to PUT Level 9) is being made available through this website to TPF customers. The Apache code with secure web server support is provided for our customers convenience and for the sole purpose of testing the Apache code on TPF in their own environments.

TPF customers who wish to obtain a copy of the Apache code with the modifications, must indicate their acceptance of the terms and conditions of this agreement by clicking on the Accept button at the end of this page. Supply your TPF customer userid and password used for accessing TPF tools restricted to customers to access the source code with the modifications from this website.

Apache code is not an IBM product, it is software developed and maintained by the Apache Group for use in the Apache HTTP Server Project (http://httpd.apache.org/). IBM is providing the Apache code and modifications directly from this website solely for the convenience of its TPF customers. The Apache code is licensed to you directly from the participants in the Apache Group under the Apache license terms. As required by the Apache Group license, IBM is including the Apache license terms as Appendix A, attached below. You agree that your use of the Apache code is governed by the Apache license terms and not the IBM Customer Agreement. You also agree to comply with all of the requirements of the Apache license terms.

IBM is providing the Apache code and modifications to you on an AS IS basis without warranty of any kind. IBM EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF NON-INFRINGEMENT. You agree that the entire risk arising out of use or performance of the Apache code and modifications (whether on TPF or otherwise) remains with you and that IBM shall have no liability to you whatsoever (whether for direct, indirect, economic consequential, incidental, special or other damages) from your use of the Apache code and modifications with TPF or any other product, including, but not limited to any claims for indemnification for infringement of third party intellectual property rights from your use of the Apache code and modifications.

You further agree that:

  1. IBM may alter or enhance the format or content of the software code provided to you pursuant to the terms of this agreement at any time without prior notification.
  2. IBM may terminate or modify the terms and conditions of this agreement at any time for its convenience. Upon any such termination, you agree to destroy all copies of the Apache code and modifications provided to you pursuant to this agreement.
  3. You may not sublicense, assign, transfer or distribute the Apache code with the modifications to any third party.
  4. You may not sell, transfer, assign or subcontract any of your rights or obligations under these terms and conditions.
